Privacy policy

The short version: your audio stays on your Mac. The app only goes online to check your license, and then it sends your license key and a neutral label for your Mac. The website sets no cookies and does not track you.

Who is responsible

Keybeat is made by Triple Four, the trade name of 444 ent AS, a limited company in Norway. We are the data controller for the license check, for the order details we receive, for support email and for this website.

Your audio

The app listens to the sound your Mac plays, or to the microphone, and works out the key and tempo.

  • Audio stays on your Mac. All analysis runs on your Mac, in memory. Audio is never sent to us or to anyone else.
  • Audio is not stored. The app keeps up to about a minute of sound in memory while it works, then discards it. It writes no audio to disk. The one exception is a test mode for Terminal that saves a recording to a file you name. It only runs when you start it yourself.
  • Files you analyze stay put. When you use Analyze Audio File, the app reads the file on your Mac. It does not copy or upload it.

Your settings (for example whether Camelot names are on) are saved in the normal macOS preferences on your Mac. They never leave it.

The license check

The license check is the only reason the app goes online. It talks to the license service of our payment provider (see Purchases).

What the app sends
Your license key. A device label made of your Mac's model code and a short random code, for example "Mac15,3 ยท 4F2A". The same label shows in the app, so you can tell your Macs apart in the customer portal. Not your computer's name, not its serial number. The app version. When you activate, the license service returns an activation ID, which the app keeps in your Mac's Keychain and sends with later checks.
When
Once when you activate a Mac. About once a week after that, when the Mac is online. And when you deactivate a Mac to free up a slot.
What it never sends
Audio, file names, song titles, the keys or tempos it found, or how often you use the app.
What the other side sees
Like any request over the internet, the license service also sees your IP address.
Why
To confirm the key is valid and that it is active on no more than 2 Macs at a time. The legal basis is our contract with you (GDPR article 6(1)(b)).
How long
Each activation is kept while it is active. When you deactivate a Mac, in the app or in the customer portal, that activation is removed. The license key itself is kept as long as your license exists.

The app works offline. If it cannot check for a while, it keeps working for about 30 days before it asks you to go online once.

Update checks

The app does not check for updates yet. When we add this, the app will ask our server whether a newer version exists. That request contains the app version and nothing personal. Our server sees your IP address, as with any web request.

Purchases

The checkout is run by Polar (Polar Software, Inc., USA), our merchant of record. It resells Keybeat for us, is the seller on your receipt and handles payment, VAT and sales tax.

For the checkout it collects your name, email address, billing address and payment details, and handles them as a controller in its own right, under its own privacy policy. We never see your card number.

The payment provider shares some order details with us: your name, email address, country, what you bought, the order number, your license key and its activations. We use them to deliver your license, answer support questions and handle refunds. The legal basis is our contract with you, and our duty to keep accounting records (article 6(1)(c)).

This website

  • No cookies. The site sets none.
  • No tracking and no analytics. No analytics script, no advertising pixel, no social media buttons.
  • Nothing from other companies. Fonts, scripts and images all come from our own server.

Our web server keeps standard access logs: IP address, the page requested, the time and the browser type. We use them to keep the site secure and to fix errors (legitimate interest, article 6(1)(f)). Logs are deleted after 30 days.

The download file may be served from our file storage provider. It sees your IP address when you download, and keeps short-lived logs for the same reasons.

Email

If you email us, we use your message to answer you (legitimate interest). We do not add you to a mailing list. If we ever start a newsletter, it will be opt-in only.

Who we share data with

We do not sell personal data, and we do not share it for advertising. The only companies involved are:

  • the payment provider named above (checkout, receipts, license keys and the license check),
  • our hosting and file storage providers (this website and the download),
  • our email provider (support email).

The payment provider is based in the United States, so order and license data is processed there.

How long we keep data

  • Audio: never stored.
  • License activations: until you deactivate that Mac.
  • Order records: as long as Norwegian bookkeeping law requires (up to five years after the end of the financial year), then deleted.
  • Support email: as long as we need it to help you, and no more than two years after your last message, unless it is part of an order record.
  • Web server logs: 30 days.

Your rights

Under the GDPR you can ask us to:

  • tell you what personal data we hold about you and give you a copy,
  • correct data that is wrong,
  • delete your data, where the law does not require us to keep it,
  • limit how we use your data, or object to a use based on legitimate interest,
  • give you your data in a common format.

Email us and we will answer within one month. Deleting your license data also ends your license check, so the app would stop working on your Macs.

You can also complain to the Norwegian Data Protection Authority, Datatilsynet, or to the data protection authority in the country where you live.

Children

The app and this website are not aimed at children under 13, and we do not knowingly collect data from them.

Changes

When we change this policy, we update the date at the top. If a change affects what the app sends, we will also say so in the release notes of that version.
